Justice does not always mean fairness in the democratic society. How can the media justify revealing corporate scandals in the grey zone where there is no guarantee that the police will investigate or that prosecutors will prosecute?
But justice, even in the case of democratic societies, is not the same as majority rule. In its role as the “Fourth Estate,” the media can and should investigate corporate scandals that may not lead to criminal prosecution. Investigative reporting is a type of “state of exception” that goes beyond what the government itself can investigate to give the public greater access to information.
